ROCCIBEL LLC WEBSITE TERMS AND CONDITIONS OF USE

Welcome to zenttu.com (the "Site"), operated by ROCCIBEL LLC ("ROCCIBEL," "we," or "our"), a company organized under the laws of the State of Texas, United States of America. By accessing and browsing this Site, or by making a purchase, you ("Consumer") accept the following Terms and Conditions of Use ("Terms"), which govern use of the Site and the services offered through it.
Definitions
For purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:
Privacy Notice: A document adopted by ROCCIBEL governing the processing of personal data collected through the Site, in compliance with applicable law, including the Texas Data Privacy and Security Act (TDPSA).
Cookies: Small files that a website places on your computer, mobile device, or any other device, which contain details of your browsing history on that website, among their many uses.
Informed Consent: Authorization freely, specifically, previously, and unambiguously granted by the User, by which the processing of their personal data is approved for the purposes disclosed by ROCCIBEL.
User-Generated Content: Information, comments, opinions, ratings, images, or any other content posted by Users through the Site or its associated channels.
User Account: A personal registration created by the User to access specific Site functionalities, make purchases, view their order history, and manage their personal information.
Force Majeure: Any unforeseeable, irresistible event beyond ROCCIBEL's control that prevents or hinders performance of its contractual obligations, such as natural disasters, technological failures, pandemics, governmental acts, among others.
Payment Methods: Instruments accepted on the Site for the purchase of products or services, such as credit cards, debit cards, bank transfers, payment gateways, or other enabled methods.
Electronic Notification: Any communication sent by ROCCIBEL to the User through digital means, including email, messages through the Site, or push notifications.
Estimated Delivery Time: The approximate time within which an order will be shipped and delivered to the User, subject to inventory availability, geographic location, and logistical conditions.
Products and Services: Tangible or intangible goods offered by ROCCIBEL, including, but not limited to, beauty items, personal care products, devices, advisory services, or any other product or service available on the platform.
Promotions or Commercial Campaigns: Offers, discounts, benefits, or commercial initiatives launched by ROCCIBEL for a limited time, subject to specific conditions previously communicated.
Site or Platform: ROCCIBEL's official website through which products and services are marketed to the consumer.
Third Parties: Any natural or legal person other than ROCCIBEL that participates in or provides services related, directly or indirectly, to the Site, such as payment processors, technology platforms, hosting services, among others.
Processing of Personal Data: Any operation or set of operations performed on personal data, such as collection, use, storage, transmission, modification, or deletion, carried out by ROCCIBEL as controller or processor.
User or Consumer: Any natural or legal person who accesses, browses, consults, or makes purchases on the Site, thereby accepting these Terms and Conditions.
Marketing Message or Promotional Message: An SMS communication sent by ROCCIBEL to the Consumer for the purpose of promoting products, services, offers, discounts, events, product launches, abandoned-cart reminders, or any content of a commercial or advertising nature. It requires the Consumer's Prior Express Written Consent (PEWC).
Transactional Message: An SMS communication sent by ROCCIBEL to the Consumer within the framework of a pre-existing commercial relationship, for the sole purpose of informing about the status of an order, confirming a transaction, notifying a recurring charge, communicating a payment failure, confirming a cancellation, or conveying operational information directly related to a service requested by the Consumer. Once it includes any promotional element, it is reclassified as a Marketing Message.
Opt-In: The act by which the Consumer grants express and affirmative consent to receive text messages from ROCCIBEL, by actively checking the box enabled for that purpose during the Website checkout process or through another expressly authorized subscription mechanism.
Opt-Out: The act by which the Consumer revokes their consent to receive marketing text messages from ROCCIBEL through the enabled channels.
Prior Express Written Consent (PEWC): A written agreement by which the Consumer authorizes ROCCIBEL to send them marketing text messages, in accordance with the requirements set forth in the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and 47 C.F.R. § 64.1200(f)(9).
SMS Program: The text-messaging service operated by ROCCIBEL, through which transactional messages and marketing messages are sent to the Consumer, depending on the type of consent previously granted. The complete terms of the SMS Program are governed by the SMS Text Message and Notification Consent Policy, available on the Website.
Billing Cycle: The period of time elapsing between one recurring charge and the next, according to the frequency of the Subscription Plan contracted by the Subscriber. At the end of each Cycle, and absent prior cancellation, the system automatically executes the charge corresponding to the next cycle.
Customer Portal: A self-service platform through which the Subscriber can independently manage their subscription, including modifying delivery frequency, product quantity, shipping address, pausing or skipping cycles, updating the payment method, and canceling the subscription.
Dunning (Payment Failure Management): An automated process by which the Subscriber is notified of a failure in processing a recurring charge and is provided a secure link to update their payment method, retrying the charge according to the rules configured by ROCCIBEL before proceeding with automatic cancellation of the subscription for non-payment.
Magic Link: A unique, temporary, and expiring link sent by email to the Subscriber to access the Customer Portal without needing a password. It constitutes the Subscriber's secure authentication mechanism on the Customer Portal.
Pre-Charge Notification: A transactional communication sent by email to the Subscriber three (3) days before the automatic charge for the next Billing Cycle is executed, informing the amount, the date, and the payment method to be charged.
Subscription Plan: A recurring purchase arrangement offered by ROCCIBEL through the Website, by which the Subscriber authorizes the automatic and recurring charge of a specified amount in each Billing Cycle, in exchange for the periodic delivery of the selected products.
Subscriber: A natural person who has entered into a Subscription Plan offered by ROCCIBEL, granted their affirmative consent for the execution of recurring charges, and accepted the terms of the Subscription and Recurring Charges Policy.
Payment Token: An alphanumeric reference string issued by the Payment Processor that replaces the Subscriber's actual card data. It allows the Payment Processor to be instructed to execute a recurring charge without ROCCIBEL having access to the Subscriber's actual financial data.
CONDITIONS
ACCEPTANCE OF TERMS: Use of the Site is conditioned upon your acceptance of these Terms. If you do not agree with any part of them, you must refrain from using the Site. ROCCIBEL reserves the right to modify these Terms at any time without prior notice. The updated version will be available in this same section.
SHOPIFY PLATFORM: This Site is hosted and operated on the Shopify Inc. platform. By using our Site, you also accept Shopify's terms, conditions, and policies of use, available at: https://www.shopify.com/legal/terms.
PRODUCTS AND SERVICES: ROCCIBEL markets and distributes a wide range of products and services focused on wellness, personal care, and overall beauty, through its e-commerce platform. Its portfolio includes, but is not limited to, makeup, cosmetics, facial and body care products, aesthetic treatments, dermocosmetic solutions, hygiene and hair-care products, as well as accessories, beauty tools, and technological devices for professional or household use. Additionally, it may offer complementary services such as image consulting, personal care routines, or personalized guidance in the use of its products. ROCCIBEL reserves the right to add new business lines as the market evolves, without needing to expressly amend this document. All products and services are subject to availability, logistical coverage, and inventory conditions. Likewise, the company may limit or suspend, at any time and without prior notice, the offering of specific products or services, or restrict the quantity of units per customer, for operational, commercial, or strategic reasons.
PURCHASE PROCESS: By making a purchase, you represent that:
You are at least 18 years of age or have the authorization of a legal guardian.
The information provided is true, accurate, and up to date.
You agree to pay the total amount specified, including taxes and shipping costs, as applicable.
If you choose to enter into a Subscription Plan, you must also give separate and independent express consent for the execution of recurring charges, in accordance with the SUBSCRIPTION AND RECURRING CHARGES PROGRAM section of these Terms.
PRICING AND BILLING: Prices are stated in United States dollars (USD). We reserve the right to change prices without prior notice. Applicable taxes and fees will be itemized before payment is confirmed.
INTELLECTUAL PROPERTY: All content on the Site, including text, images, logos, graphics, and design, is the exclusive property of ROCCIBEL or its licensors and is protected by intellectual property laws. Unauthorized reproduction or use is prohibited.
PERSONAL DATA PROTECTION AND PRIVACY: ROCCIBEL collects and processes personal data in accordance with its Privacy Notice and the Texas Data Privacy and Security Act (TDPSA). Additionally, the processing of personal data in the context of the SMS Program is governed by ROCCIBEL's SMS Text Message and Notification Consent Policy, which supplements this document. The Privacy Notice is available on the Website. Any request may be submitted through support@zenttu.com.
COOKIES: The Site uses cookies managed by Shopify to optimize the user experience. For more information, please see our Cookie Policy.
USER CONDUCT: You agree not to use the Site for illegal, fraudulent, or immoral purposes, including but not limited to: identity theft, distribution of malware, automated use of the Site, or unauthorized resale of our products.
DISCLAIMER AND LIMITATION OF LIABILITY: ROCCIBEL does not warrant that the Site will be free of errors, viruses, or interruptions. To the maximum extent permitted by applicable law, we will not be liable for direct, indirect, or incidental damages arising from use of the Site or the inability to use it.
Accordingly, ROCCIBEL will not be liable for interruptions, delays, technical failures, or errors in service delivery arising from services provided by third parties, including, but not limited to, technology platforms such as Shopify Inc. or external payment processors. Such third parties are responsible for their own services, and any related claim must be directed to them directly. To the maximum extent permitted by applicable law, ROCCIBEL's total and aggregate liability to the Consumer for any claim arising out of or related to use of the Site, the Products and Services, the SMS Program, the Subscription Program, or these Terms - whether based on contract, tort (including negligence), or any other legal theory - will not exceed, in any case, the greater of (i) one hundred U.S. dollars (USD 100), or (ii) the amount actually paid by the Consumer to ROCCIBEL for the specific product or service giving rise to the claim, during the twelve (12) months preceding the date on which the event giving rise to the claim occurred.
The foregoing liability cap will not apply and, accordingly, will not limit ROCCIBEL's liability in the following cases: (a) violations of the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) or the Texas Business & Commerce Code Chapter 302 (Texas Mini-TCPA); (b) claims subject to mandatory statutory damages under applicable law; (c) gross negligence, fraud, or willful misconduct by ROCCIBEL; (d) infringement of third parties' intellectual property rights; (e) breach of confidentiality obligations; (f) the indemnification obligations assumed by ROCCIBEL in these Terms; and (g) personal injury or harm to health arising from ROCCIBEL's negligence in the manufacture, packaging, or distribution of the Products. The limitations of liability set forth in this clause will apply only to the extent permitted by applicable law, including the law of the State of Texas and U.S. federal law, and are not intended to exclude or limit ROCCIBEL's liability in cases where such exclusion or limitation is not permitted by law.
RIGHT TO OPT OUT OF THE SALE OF DATA: ROCCIBEL will not sell or share your personal data with third parties for advertising or commercial purposes without your explicit and verifiable consent. Consumers may exercise their voluntary opt-out right by contacting our official email directly at support@zenttu.com.
SMS PROGRAM - CONSENT FOR TEXT MESSAGES: By providing their mobile phone number during the Site's checkout process and checking the box enabled for that purpose, the Consumer grants their Prior Express Written Consent (PEWC) to receive marketing text messages from ROCCIBEL, in accordance with the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and the Texas Data Privacy and Security Act (TDPSA). If the Consumer provides their phone number without checking that box, they will only receive transactional messages related to their order. The consent checkbox is never pre-checked; the Consumer's affirmative act is an essential requirement. The complete terms of the SMS Program, including message types, frequency, applicable rates, Opt-Out mechanisms, and Consumer rights, are set out in the SMS Text Message and Notification Consent Policy, available at https://zenttu.com/ and https://zenttu.com/es , which forms an integral part of these Terms. The Consumer may revoke their consent at any time by sending an email to support@zenttu.com with the subject line 'SMS PROGRAM OPT-OUT'; the Opt-Out will be processed within a maximum of three (3) business days. The SMS Program is not directed at persons under eighteen (18) years of age.
SUBSCRIPTION AND RECURRING CHARGES PROGRAM: ROCCIBEL offers Subscription Plans with recurring charges on selected products from its portfolio, in accordance with the Subscription and Recurring Charges Policy, which forms an integral part of these Terms, available at https://zenttu.com/ and https://zenttu.com/es . Entering into a Subscription Plan requires the Subscriber's free, prior, express, and informed consent, obtained through the positive act of checking the enabled box - which is never pre-checked - and completing the checkout process, in accordance with the Restore Online Shoppers' Confidence Act (ROSCA, 15 U.S.C. § 8403). Before requesting billing information, ROCCIBEL will clearly and conspicuously disclose the material terms of the Plan: product, amount per cycle, charge frequency, and cancellation mechanism. ROCCIBEL will send a Pre-Charge Notification three (3) days before each recurring charge. The Subscriber may cancel their subscription at any time, without early-termination charges, through the Customer Portal (accessible via Magic Link) or by sending an email to support@zenttu.com with the subject line 'SUBSCRIPTION CANCELLATION'. Orders executed under the Subscription Program are subject to the returns and refunds policy described in the corresponding section of these Terms; approved refunds are processed manually within seven (7) to ten (10) business days. The Subscriber's personal data is processed in accordance with ROCCIBEL's Privacy Policy and the TDPSA. The Subscription Program is not available to persons under eighteen (18) years of age.
RETURNS AND REFUNDS POLICY: At ROCCIBEL LLC, we are committed to the quality and satisfaction of our customers. All of our products - including but not limited to makeup, skincare, cosmetics, and facial and body treatments - are sold through our e-commerce channel and are subject to the following conditions for returns and refunds: Orders executed under the Subscription Program are equally subject to these conditions. Approved refunds on subscription orders are processed manually within seven (7) to ten (10) business days to the original payment method, in accordance with ROCCIBEL's Subscription and Recurring Charges Policy.
Products not eligible for return: For reasons of hygiene, safety, and consumer protection, we do not accept returns of the following products, except where they present manufacturing defects or damage attributable to the shipping process:
Opened or used makeup and cosmetics.
Unsealed skin, hair, or body care products.
Personalized aesthetic treatments.
Any item that has been altered or tampered with after delivery.
Returns for defective products or shipping errors: If you receive a damaged, defective, or incorrect product, you may request a return within thirty (30) business days following receipt of the order. To do so, you must contact our customer service team at support@zenttu.com by attaching the order number, a description of the issue, and photographic evidence of the affected product. Once the request has been validated, we will send you instructions for returning the product. In these cases, ROCCIBEL will bear the shipping costs and will arrange for the replacement or refund, as applicable.
Refund procedure: After receiving and inspecting the returned product, we will notify the customer whether the refund has been approved. If applicable, the refund will be issued within seven (7) to ten (10) business days to the same payment method used in the purchase. Original shipping costs will not be refunded, except where the return is due to our error.
Once the returned item has been received and inspected:
You will receive an email notification regarding the approval or denial of your refund.
If approved, the refund will be issued to the original payment method within seven (7) to ten (10) business days, or in accordance with the policies of the relevant bank.
Refunds will not be processed for:
Items returned showing signs of use.
Opened products (unless defective).
Items outside the 30-day period.
Sale or promotional items (unless defective)
Product exchanges: We do not offer product exchanges. If you require a different item, the customer must make a new purchase in accordance with availability published on the website.
Shipping costs: If the return is due to an error by Roccibel LLC (for example, incorrect, damaged, or defective items), we will bear the cost of the return and provide a prepaid label.
For other reasons (for example, change of mind or incorrect order), the customer will be responsible for return shipping costs. We recommend using a trackable shipping service, as we do not guarantee receipt of untracked returns.
Exchanges: We do not offer direct exchanges. If you would like a different item, please follow the return process and place a new order.
TERMINATION: ROCCIBEL reserves the right to suspend or cancel any Consumer's access to the Site who breaches these Terms, without the need for prior notice.
GOVERNING LAW AND JURISDICTION: These Terms will be governed by and construed in accordance with the laws of the State of Texas, USA, without giving effect to its conflict-of-laws rules. With respect to electronic communications and text messages (SMS Program), the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), the Texas Business & Commerce Code Chapter 302 (SB 140), and other relevant federal and state regulations will additionally apply. With respect to subscriptions and recurring charges, the Restore Online Shoppers' Confidence Act (ROSCA, 15 U.S.C. § 8403), the Texas Business & Commerce Code Chapter 601 (SB 838), and other applicable federal and state regulations governing subscription and auto-renewal contracts will additionally apply.
Arbitration Agreement: Unless the Consumer exercises the opt-out right described below, ROCCIBEL and the Consumer agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Products and Services, the SMS Program, or the Subscription Program - including their existence, validity, scope, or termination - will be resolved through binding, individual arbitration administered by the American Arbitration Association (AAA), in accordance with its consumer arbitration rules in effect at the time the proceeding is initiated, and not in court. The arbitration will be governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) and will take place in the Texas county corresponding to ROCCIBEL's principal place of business, or at a location mutually agreed upon by the parties.
Class Action Waiver: The Consumer and ROCCIBEL agree that any proceeding will be conducted only on an individual basis, and not as a class, collective, consolidated, or representative action. The arbitrator may not consolidate the claims of more than one consumer or preside over any form of representative or class proceeding.
Voluntary Opt-Out of Arbitration: The Consumer may opt out of this arbitration clause and the class action waiver, without penalty, by sending written notice to support@zenttu.com within thirty (30) days after the date on which they first accepted these Terms, stating their name, address, and express intent to opt out. If the Consumer exercises this right, the dispute will be resolved in accordance with the Residual Jurisdiction paragraph.
Exceptions: Either party may bring an action in small claims court for disputes that qualify within its jurisdiction, and ROCCIBEL may seek injunctive relief from a court of competent jurisdiction to protect its intellectual property rights or confidential information.
Residual Jurisdiction: For any dispute not subject to arbitration (including those in which the Consumer has validly exercised the opt-out), the parties submit to the exclusive jurisdiction of the competent state or federal courts of the State of Texas.
Severability: If the class action waiver is found unenforceable with respect to a particular dispute, that dispute may not be arbitrated on a class basis; the remainder of this clause will remain in effect. If the remainder of the arbitration clause is found unenforceable, the dispute will be resolved in accordance with the Residual Jurisdiction paragraph.
